Terms and Conditions of Sale

Article 1 — Purpose

These General Terms and Conditions of Sale (Conditions Générales de Vente, “CGV”) govern the sales of products offered on the BURGAS.FR website (hereinafter “the Site”) to any non-professional customer (hereinafter “the Customer”). Any order placed on the Site implies prior, full and complete acceptance of these CGV. The seller reserves the right to amend the CGV at any time; the applicable CGV are those in force on the date of the order.

Article 2 — Products

The products offered for sale are described and presented as accurately as possible. The photographs and descriptions are provided for guidance only and bind the seller solely with respect to the essential characteristics of the product. Offers are valid while stocks last.

Article 3 — Prices

Prices are shown in euros (€), all taxes included (TTC), excluding delivery costs. Any delivery costs are indicated before the order is confirmed and charged in addition. The seller reserves the right to amend its prices at any time, it being understood that the price shown in the catalogue on the day of the order is the only one applicable to the Customer.

Article 4 — Ordering

The Customer places an order online via the Site's purchase process. The order is final only after confirmation by e-mail summarising the essential details (products, price, quantities, delivery address). The seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to payment of a previous order, or in the event of suspected fraud.

Article 5 — Payment

Payment is made online by credit card or any other method offered at checkout, through a secure payment provider. The transaction is encrypted and the Site never has access to the Customer's full bank details. The order is charged upon its validation. If payment authorisation is refused, the order is automatically cancelled.

Article 6 — Delivery

Products are delivered to the delivery address indicated by the Customer when ordering. Delivery times are provided for guidance:

  • Preparation and shipping: 1 to 3 business days after confirmation of the order.
  • Transit: 7 to 15 business days depending on the destination.
  • Total estimated time: 8 to 18 business days.

The Customer is informed of the tracking of their order by e-mail as soon as it ships. In accordance with article L.216-1 of the Code de la consommation, unless otherwise stated, the seller delivers no later than 30 days after the conclusion of the contract. In the event of delay, the Customer may, after formal notice remaining unsuccessful, terminate the contract and obtain a full refund. The risks of loss of or damage to the products are transferred to the Customer upon physical delivery of the product.

Article 7 — Right of withdrawal

In accordance with articles L.221-18 et seq. of the Code de la consommation, the Customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to justify any reason or pay any penalty.

To exercise this right, the Customer notifies their decision by e-mail to oualiking782@gmail.com by means of an unambiguous statement (or via the standard withdrawal form). The product must be returned in its original condition and complete, within 14 days following the notification. Return shipping costs are borne by the Customer, except for a defective or non-conforming product (see Article 8).

The seller refunds all sums paid, including standard delivery costs, no later than 14 days after being informed of the decision to withdraw. The refund may be deferred until the product is recovered or until the Customer provides proof of its shipment. The refund is made using the same payment method as the one used for the order.

BURGAS commercial offer — 30-day return: in addition to the statutory right above, BURGAS offers an extended commercial return period of 30 days from receipt, for any unused product in its original packaging. The terms are detailed on our Returns & refunds page.

Article 8 — Legal warranties

Independently of any commercial warranty, the seller remains bound by the following legal warranties:

  • Legal warranty of conformity (articles L.217-3 et seq. of the Code de la consommation): the Customer has 2 years from delivery of the product to act; they may choose between repair or replacement, subject to the cost conditions provided for by law. They are exempt from proving the existence of the lack of conformity during the 24 months following delivery.
  • Warranty against hidden defects (articles 1641 et seq. of the Code civil): the Customer may obtain the rescission of the sale or a price reduction in the event of a hidden defect rendering the product unfit for its use.

In the event of a defective or non-conforming product, the return and re-shipping costs are fully covered by the seller. The Customer contacts oualiking782@gmail.com for implementation.

Article 9 — Personal data

The processing of the Customer's personal data is described in our Privacy Policy, which complies with the GDPR.

Article 10 — Disputes and mediation

These CGV are subject to French law. In the event of a dispute, the Customer contacts customer service first at oualiking782@gmail.com to seek an amicable solution. Failing resolution, the Customer may refer the matter free of charge to the consumer mediator:

The Customer may also use the European Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr. Failing an amicable agreement, any dispute falls within the jurisdiction of the French courts.
